Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

HOW TO ORDER THROUGH THE SITE
After placing an order, you will receive an email from us acknowledging that we have received your order ("Order Confirmation"). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming the shipment of your order (the "Shipping Confirmation"). A contract with us will only be formed when we send you the Shipping Confirmation. The contract will relate only to those products whose shipment we have confirmed in the Shipping Confirmation. We will not be obliged to supply any other products which may have been part of your order in a separate Order Confirmation. We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the product is no longer in our inventory.
PRICES AND AVAILABILITY OF PRODUCTS
While ExactRail strives to provide accurate pricing information, pricing or typographical errors may occur. ExactRail cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price due to an error in pricing, ExactRail shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is mispriced, ExactRail, at our discretion, honor the pricing error, either contact you for instructions or cancel your order and notify you of such cancellation.
ORDER ACCEPTANCE
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. For your convenience, you will not be charged until your payment method is authorized, the order information is verified for accuracy and your order is shipped. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge.
RETURN POLICY
At ExactRail we strive to make your experience shopping with us a great. We do everything we can to assure you get the merchandise quickly and exactly what you ordered. If for any reason you are not satisfied with your order, we will be happy to accept returns within 30 days under the following guidelines.
You may return new, unopened items within 30 days of delivery for a full refund. Items should be returned in their original product packaging. Please contact us for a return authorization number prior to returning your order. Shipping charges will not be refunded. The customer is responsible for insured shipping back to our warehouse. Returns sent COD will not be accepted.
DAMAGED PRODUCT
If a package has been damaged in shipping and it is apparent when the package arrives, please REFUSE the delivery. If you discover the item has been damaged after you have accepted the page please contact us as soon as possible. Make sure you keep all of the packaging material and paperwork with the damaged product. The shipping company may need the materials to process the claim. Please do not return damaged-in-shipment merchandise yourself. It could jeopardize your claim and keep you from receiving credit for the return.
DEFECTIVE MERCHANDISE
If you receive defective merchandise, please contact us for return instructions. In most cases, we will accept returns and make adjustments. Please also contact us if you receive products that are missing parts. We will make sure that you receive the part or we will exchange the merchandise.
APPLICABLE LAW
If you access the Site from anywhere other than the United States or Canada, you agree that English law will govern these Terms and Conditions and the purchase of products by you through the Site and that any dispute of any sort that might arise between you and ExactRail or its affiliates and subsidiaries shall be subject to the exclusive jurisdiction of the courts of Utah, United States.

HOW TO ORDER THROUGH THE SITE
After placing an order, you will receive an email from us acknowledging that we have received your order ("Order Confirmation"). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming the shipment of your order (the "Shipping Confirmation"). A contract with us will only be formed when we send you the Shipping Confirmation. The contract will relate only to those products whose shipment we have confirmed in the Shipping Confirmation. We will not be obliged to supply any other products which may have been part of your order in a separate Order Confirmation. We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the product is no longer in our inventory.
PRICES AND AVAILABILITY OF PRODUCTS
While ExactRail strives to provide accurate pricing information, pricing or typographical errors may occur. ExactRail cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price due to an error in pricing, ExactRail shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is mispriced, ExactRail, at our discretion, honor the pricing error, either contact you for instructions or cancel your order and notify you of such cancellation.
ORDER ACCEPTANCE
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. For your convenience, you will not be charged until your payment method is authorized, the order information is verified for accuracy and your order is shipped. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge.
RETURN POLICY
At ExactRail we strive to make your experience shopping with us a great. We do everything we can to assure you get the merchandise quickly and exactly what you ordered. If for any reason you are not satisfied with your order, we will be happy to accept returns within 30 days under the following guidelines.
You may return new, unopened items within 30 days of delivery for a full refund. Items should be returned in their original product packaging. Please contact us for a return authorization number prior to returning your order. Shipping charges will not be refunded. The customer is responsible for insured shipping back to our warehouse. Returns sent COD will not be accepted.
DAMAGED PRODUCT
If a package has been damaged in shipping and it is apparent when the package arrives, please REFUSE the delivery. If you discover the item has been damaged after you have accepted the page please contact us as soon as possible. Make sure you keep all of the packaging material and paperwork with the damaged product. The shipping company may need the materials to process the claim. Please do not return damaged-in-shipment merchandise yourself. It could jeopardize your claim and keep you from receiving credit for the return.
DEFECTIVE MERCHANDISE
If you receive defective merchandise, please contact us for return instructions. In most cases, we will accept returns and make adjustments. Please also contact us if you receive products that are missing parts. We will make sure that you receive the part or we will exchange the merchandise.
APPLICABLE LAW
If you access the Site from anywhere other than the United States or Canada, you agree that English law will govern these Terms and Conditions and the purchase of products by you through the Site and that any dispute of any sort that might arise between you and ExactRail or its affiliates and subsidiaries shall be subject to the exclusive jurisdiction of the courts of Utah, United States.
